1. Definitions
1.1 “Services” means any and all of the residential and small business long distance voice services and related products offered by G3 Telecom Inc. (“G3”).
1.2 “You”, “your” and “customer” refer to the person or entity that subscribes to or uses the Services.
1.3 “Credits” means prepaid or calling‐credits, vouchers or units of service purchased by you for use with the Services. “Unused Credits” means any Credits remaining in your account that have not been applied toward calls or other service usage at the time of cancellation or refund request.
1.4 “Business day” means a day other than a Saturday, Sunday or statutory holiday in Ontario, Canada.
1.5 Other defined terms in these Terms have the meaning given to them where the term first appears.
2. Services, Use and Eligibility
2.1 You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction) and capable of entering into a binding contract.
2.2 You agree to provide true, complete and current information about yourself and your account, and to maintain and update such information as necessary.
2.3 You agree that the Services are for your own use and not for resale unless expressly authorized by G3 in writing.
2.4 You acknowledge that the Services use the internet, telecommunications networks and third‐party carriers and therefore may be subject to latency, delay, interruption or other disruption.
3. Billing, Payment and Credits
3.1 When you subscribe to the Services, you agree to pay all applicable fees, taxes, surcharges and any other amounts set out in your invoice or online account.
3.2 G3 bills you in advance or in arrears as described in your plan or agreement.
3.3 Credits: When you purchase Credits, those Credits will be applied toward calls or features in accordance with your plan. Credits are non‑refillable unless otherwise indicated, and no interest is paid on Credits.
3.4 Credit Expiry: All Credits expire sixty (60) days from the date of purchase (unless otherwise explicitly stated in your plan documentation). After expiry, any remaining Credits will be forfeited and cannot be refunded.
3.5 If payment is not received by the due date, G3 may suspend or terminate your Service and charge late fees or interest as permitted by law.
3.6 You may dispute a billing item by contacting G3 within thirty (30) days of receipt of the invoice. If you do not, the item shall be deemed accepted.
4. Refund and Cancellation Policy
4.1 Cancellation by You: You may cancel the Services and request a refund of any Unused Credits by contacting G3’s customer service team within seven (7) business days of your initial purchase.
4.2 Unused Credits Only: Refunds will only apply to Credits that remain unused at the date of cancellation. Credits already applied toward calls or features are non‑refundable.
4.3 Method of Refund & Timing: Refunds will be processed via the original payment method used, or another method as agreed by G3. Processing may take up to thirty (30) calendar days. Any transaction fees, currency exchange differences, or taxes/duties incurred may be deducted from the refund.
4.4 Cancellation by G3: G3 may cancel or terminate your Service for cause (including misuse, fraud, non‑payment). In such event, G3 may, at its sole discretion, refund any Unused Credits, less amounts owed by you.
4.5 No Refunds after Expiry: If the 7‑business‑day cancellation period lapses, or if Credits expire per clause 3.4, such Credits become non‑refundable.
4.6 Nothing in these Terms shall limit any refund rights you may have under applicable law.
5. Use Restrictions, Fraud, Misuse & Security
5.1 You must protect all credentials, account access data, authorization codes, and devices used for the Services. You are responsible for all charges resulting from any use of your account, unless such use is caused by G3’s gross negligence or willful misconduct.
5.2 Prohibited activities: (a) Reselling, sharing, distributing or assigning the Services, Credits, authorization codes or devices without G3’s prior written consent. (b) Using the Service for any fraudulent, abusive or unauthorized purpose (including but not limited to unauthorized calling card use, reselling VoIP/long‑distance services, spoofing caller identification, circumventing billing mechanisms, high‑volume calls inconsistent with residential use). (c) Permitting access to the Service by any third party for a fee or other benefit.
5.3 G3 may monitor, audit and analyze your usage patterns (for example high volume international calls, unusual destinations, repeated failed calls) to detect potential fraud or abuse. During investigation G3 may suspend or terminate your Service without notice.
5.4 If G3 determines, in its sole discretion, that fraudulent or abusive use has occurred, G3 may immediately suspend or terminate your Service, void your refund rights under clause 4, and seek recovery of all costs, losses or damages resulting from such use.
6. Termination and Suspension
6.1 Termination by You: You may terminate your subscription by written/email notice to G3 and returning any equipment if required. Termination will not relieve you of any outstanding charges.
6.2 Termination by G3: G3 may terminate or suspend the Services at any time for cause (including breach of these Terms, non‑payment, fraud, regulatory requirement) with or without notice.
6.3 Effect of Termination: Upon termination you must immediately cease using the Services, return or pay for any equipment (if applicable) and settle all amounts owing. Any Unused Credits will be handled strictly under clause 4.
6.4 Survival: All provisions which by their nature should survive termination (including payment obligations, refunds, fraud/misuse provisions, disclaimer of warranties and limitation of liability) shall so survive.
7. Amendments to Terms
7.1 G3 may modify these Terms—including fees, Credits, usage policies, refund terms and expiry rules—by posting an updated version on its website. Unless immediate changes are required by law or a regulatory body, G3 will provide at least thirty (30) days’ notice.
7.2 Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
8. Warranties, Limitation of Liability & Indemnity
8.1 The Services are provided “as is” and “as available” without warranty of any kind.
8.2 G3 is not liable for indirect, incidental, special or consequential damages.
8.3 You indemnify G3 against claims arising out of your misuse of the Services or violation of these Terms.
9. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless otherwise specified in your individual plan or agreement.
10. General Provisions
10.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.2 Headings are for convenience only and do not affect interpretation.
10.3 These Terms constitute the entire agreement between you and G3 regarding the subject matter herein and supersede all prior or contemporaneous communications.
